Section 12
Executive Chief

(1) The Government of Nepal shall appoint a person who has obtained a master's degree from a university recognized by the Government of Nepal and has at least ten years of experience in the relevant field to work as the administrative head of the authority as the executive head on the recommendation of the committee under sub-section (2).
(2) The Government of Nepal shall form a committee with two other expert members under the coordination of the Secretary of the Ministry to recommend the name of a suitable person for the appointment of the Chief Executive. The procedure to be followed while recommending the appointment of the executive head and the meeting procedure will be as determined by the committee itself.
(3) The term of office of the Executive Chief shall be five years.
(4) Notwithstanding anything written in subsection (3), if the performance of the Chief Executive is not satisfactory, the Government of Nepal may remove him from the position of Chief Executive at any time.
(5) According to sub-section (4), before removing him from the position of the executive head, he should be given a reasonable opportunity to present his justification.
(6) The Executive Head shall work under the direct control of the Executive Committee and shall be accountable to the Council and the Government of Nepal for his performance.
(7) The Executive Chief shall act as Disaster Response Controller during a disaster.
(8) The remuneration, facilities, conditions of service and work, duties and rights of the executive head shall be as prescribed.
